Terms of Service

These Terms of Service ("Terms") govern your use of www.yankee-carpenter.net (the "Site") and your submission of inquiries, consultation requests, estimate requests, or other information to Yankee Carpenter ("Yankee Carpenter," "we," "us," or "our").

By accessing the Site or submitting information through it, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Yankee Carpenter

Yankee Carpenter provides carpentry, remodeling, water-damage repair, restoration, roofing, and related contractor services in Kennesaw, Marietta, Acworth, Cobb County, and surrounding areas of Georgia.

Information on the Site is provided for general informational and marketing purposes. The availability of a service may depend on the location, project conditions, permits, materials, scheduling, insurance requirements, and other factors.

2. Website Terms versus Project Contracts

These Terms apply to the Site and communications initiated through the Site. They do not constitute a construction contract, restoration agreement, insurance authorization, warranty, or promise to perform work.

Actual services will be governed by a separate written agreement describing matters such as:

  • The project scope and exclusions
  • Price and payment schedule
  • Materials and allowances
  • Estimated start and completion dates
  • Permits and inspections
  • Change orders
  • Warranties
  • Cancellation and termination rights
  • Insurance-related responsibilities

If these Terms conflict with a signed project agreement, the signed project agreement controls with respect to that project.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Site or request services.

If you submit a request for property you do not own, you represent that you have permission from the owner or another person with authority over the property.

4. Consultations and Estimates

Submitting a form, calling us, sending a message, or scheduling a consultation does not obligate Yankee Carpenter to accept a project.

Unless stated otherwise in a signed agreement:

  • Website descriptions and advertisements are not binding offers.
  • Preliminary estimates are based on the information available at the time.
  • Prices, schedules, and project requirements may change after an inspection or when concealed conditions are discovered.
  • A project is not accepted until the parties sign an applicable written agreement.
  • Statements concerning timing are estimates and are not guarantees.

Nothing on the Site guarantees that a particular material, service, crew, appointment, or completion date will be available.

5. Emergency and Water-Damage Requests

Yankee Carpenter may advertise emergency or 24-hour water-damage services. However, submitting an online request, leaving a voicemail, or sending a text does not guarantee an immediate response or create a duty to respond within a particular time.

For fires, electrical hazards, gas leaks, medical emergencies, structural collapse, active flooding that threatens safety, or other immediate dangers, contact 911, the appropriate utility, or another qualified emergency provider.

6. Insurance-Related Work

Yankee Carpenter may assist with documentation, estimates, communications, or restoration work connected to an insurance claim. We do not act as your insurance company, public adjuster, or attorney, and we do not determine coverage.

We do not guarantee that an insurer will:

  • Approve a claim
  • Accept a particular scope or price
  • Pay an estimate or invoice
  • Pay for upgrades, code requirements, deductibles, or uncovered work
  • Issue payment by a particular date

Any authorization to communicate with an insurer and any responsibility for project charges will be addressed in the applicable project documents.

7. Calls, Text Messages, and Emails

When you provide your contact information, you authorize Yankee Carpenter to contact you about your inquiry, estimate, appointment, project, scheduling, documentation, or billing by telephone, text message, or email.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages or HELP for assistance. Opting out of texts does not prevent us from contacting you through another appropriate method concerning an active project or legal obligation.

Consent to receive promotional messages is not a condition of purchasing services. Where legally required, we will request separate consent before sending marketing communications or using automated technology.

Calls may be monitored or recorded for quality and recordkeeping where permitted by law and with any legally required notice.

8. Privacy

Our collection and use of personal information are described in the Yankee Carpenter Privacy Policy.

By using the Site, you acknowledge that information submitted through the Site will be handled as described in that policy.

9. Information and Content You Submit

You agree to provide information that is accurate and that you are authorized to provide. This may include contact information, a service address, project descriptions, insurance information, photographs, or videos.

You retain ownership of content you submit. You give Yankee Carpenter permission to use, store, reproduce, and share that content as reasonably necessary to:

  • Respond to your inquiry
  • Evaluate or perform a project
  • Prepare estimates and documentation
  • Coordinate crews, subcontractors, suppliers, and insurers
  • Maintain business and project records
  • Comply with legal or insurance obligations

Job-site photography and any marketing use of project photographs are addressed in the Privacy Policy and, where applicable, the project agreement.

Please do not submit Social Security numbers, complete payment-card numbers, passwords, or other unnecessary sensitive information through ordinary forms, text messages, or email.

10. Acceptable Use

You may not use the Site to:

  • Violate any law or another person's rights
  • Submit false, fraudulent, threatening, or unlawful material
  • Impersonate another person or misrepresent your authority
  • Introduce malware or harmful code
  • Interfere with the Site's security or operation
  • Attempt unauthorized access to systems or information
  • Scrape, copy, or reproduce Site content for commercial purposes without permission
  • Use the Site to send spam or other unauthorized communications

We may restrict access to the Site when we reasonably believe these Terms have been violated.

11. Intellectual Property

The Site and its text, photographs, videos, designs, logos, graphics, and other original content are owned by or licensed to Yankee Carpenter and are protected by applicable intellectual-property laws.

You may view and print Site content for personal, noncommercial purposes. No other license is granted. You may not reproduce, modify, distribute, sell, or commercially exploit Site content without prior written permission.

Third-party names, logos, and trademarks belong to their respective owners.

12. Third-Party Services and Links

The Site may link to or use third-party services, including scheduling, mapping, payment, analytics, advertising, social-media, review, video, and insurance-related services.

We do not control third-party websites or their availability, security, content, or privacy practices. Your use of a third-party service is governed by that provider's terms and policies.

A link or integration does not necessarily constitute an endorsement.

13. Website Accuracy and Availability

We try to keep Site information accurate, but photographs, service descriptions, availability, pricing references, hours, and other information may be incomplete, outdated, or contain errors.

Project photographs are examples and do not guarantee identical results. Construction outcomes vary based on existing conditions, selected materials, design choices, code requirements, weather, and other circumstances.

We may modify, suspend, or discontinue any part of the Site without notice.

14. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, YANKEE CARPENTER DISCLAIMS WARRANTIES CONCERNING THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

This disclaimer applies to the Site and online content. Warranties or obligations relating to physical construction or restoration services are governed by the applicable signed project agreement and laws that cannot be waived.

15. Limitation of Liability

To the fullest extent permitted by law, Yankee Carpenter and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Site.

Our total liability for a claim arising solely from the Site will not exceed the greater of $100 or the amount you paid specifically to access the Site.

This section does not limit liability arising from physical construction services, a signed project agreement, gross negligence, intentional misconduct, or any liability that cannot legally be limited.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Yankee Carpenter harmless from third-party claims, losses, or expenses resulting from your unlawful misuse of the Site, violation of these Terms, or infringement of another person's rights.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.

Any legal action concerning the Site or these Terms must be brought in a court of competent jurisdiction located in or serving Cobb County, Georgia, unless applicable law requires another location.

Nothing in these Terms limits any non-waivable consumer right or remedy.

18. Changes to These Terms

We may update these Terms when our Site, services, or legal obligations change. Updated Terms will be posted on this page with a revised "Last Updated" date.

Changes apply prospectively from the date they are posted. A change to these website Terms will not amend an existing signed project agreement unless both parties agree in writing.

19. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent. We may assign these Terms in connection with a sale, merger, reorganization, or transfer of the business.

These Terms and the Privacy Policy constitute the entire agreement concerning use of the Site. They do not replace an applicable signed project agreement.
